BIZSEARCH PRIVACY POLICY
1. INTRODUCTION
1.1 The mobile application and website (insert URL) (collectively, the
BizSearch
Platform) is
created and controlled by BIZSEARCH PTY LTD (ACN 686 110 832) (BizSearch).
1.2 Bizearch are committed to ensuring your Personal Information is protected.
BizSearch
manage your Personal Information in accordance with the Australian Privacy Principles
set out in the Privacy Act 1988 (Cth) ( Privacy Act ).
1.3 By accessing and using the BizSearch Platform and Services you agree to this
Privacy
Policy.
1.4 This Privacy Policy outlines how BizSearch collect, store, process, share,
use and
disclose your Personal Information, and how you may access your Personal Information
kept by BizSearch or how you may make a privacy complaint.
1.5 For the purpose of this Privacy Policy:
- (a) Personal information
has the same meaning that it has under the Privacy Act,
namely, information means information or an opinion about an identified individual
or an individual who is reasonably identifiable, whether the information or opinion
is true or not and recorded in a material form or not.
- (b) Reviews
means complaints or reviews published or posted on the BizSearch
Platform about customers or clients who have not BizSearch for the goods and/or
services supplied to them by a user of the BizSearch Platform.
- (c) Sensitive Information
has the same meaning that it has under the Privacy Act,
namely information or opinions about your health, political affiliations, sexual
preferences, religious beliefs, racial or ethnic origin, criminal history or other
such
private information.
- (d) Service
means the service made available through the BizSearch Platform which
allows a user (being a supplier of goods and services) to share, publish or post
Reviews.
2. BIZSEARCH PLATFORM
2.1 BizSearch will only collect and hold Personal Information and Non-Personal
Information about you that is reasonably necessary to undertake its business
activities and functions, deliver the BizSearch Platform and Services to you, or as
otherwise permitted by law.
2.2 The type of Personal Information and Non-Personal Information that BizSearch
collects and uses depends on the type of dealings that you have with BizSearch
and includes the following:

(a) contact details and account registration information (for example, full
name,
email address and username and password);
-
(b) business information (address, business name, Australian Business Number
or
Australian Company Number);
-
(c) information about you posted or published in a Review on the BizSearch
Platform (which may include your name, address, mobile, details of the goods
and services you order and failed to pay for, amount owed and how long it has
been owed for, whether you indicated that you were satisfied with the goods
and services supplied, whether you are involved in any court or tribunal
proceedings and any other information relating to your dealings with a supplier
of goods and services);

(d) marketing data and information relating to your dealings, including
information
about: (i) the Services you have used; and (ii) the third party products and
services you have used or enquired about;

(e) information relating to your dealings, or enquiries you have made, with
BizSearch, including information about the BizSearch Platform and the
Services, any third party products and services made available through the
BizSearch Platform or complaints you have raised about Reviews, the
BizSearch Platform, the Services or any other third party products or services
made available to you on, or via, the BizSearch Platform; and
-
(f) device information which is automatically collected from you when you
visit and
navigate through the BizSearch Platform and use the Services. Such
information may include, but is not limited to, your device type; your device’s
network connections; unique device identifier, your device’s name; your device
IP address, screen size and calibration, information about your device’s web
browser and internet connection you use to access the BizSearch Platform or
Services, geolocation information, browser characteristics, device
characteristics, operating system and language preferences, dates and times
of visits to the BizSearch Platform and other usage statistics; and
-
(g) other information that you provide to BizSearch or that BizSearch may
collect
in the course of BizSearch’s relationship with you.
2.3 BizSearch do not collect your Sensitive Information. However, some of
BizSearch
services are automated and BizSearch may not recognise that you have
accidentally provided BizSearch with Sensitive Information. If you have accidentally
sent BizSearch Sensitive Information, please contact BizSearch using the contact
details set out in section 13 below.
3. How BizSearch collect Personal Information
3.1 Direct collection from you

(a) BizSearch will collect Personal Information and non-Personal Information
about
you or from visitors to the BizSearch Platform in a number of different ways.
Whenever possible, BizSearch will collect Personal Information directly from
you during the course of BizSearch dealings with you. For example, when you:

(i) setup and create a profile on the BizSearch Platform (including
when you
edit or update your profile on the BizSearch Platform or reset your
password) and when access and use the BizSearch Platform and
Services;
-
(ii) publish, share, post or submit Reviews on, or via, the BizSearch
Platform;
-
(iii) contact or correspond with BizSearch online (for example, when
you
complete online forms, or subscribe to BizSearch’s publications, alerts
and newsletters), contact BizSearch via email or telephone with a query
or request or make a comment on BizSearch social media sites or you
participate in a promotion, competition or survey;

(iv) when you apply for position of employment with BizSearch; or
-
(v) when otherwise legally authorised or required to do so.

(b) When BizSearch collect Personal Information directly from you, BizSearch
will
take reasonable steps to notify you (using a collection notice) at, before, or as
soon as practicable after, the time of collection. As a collection notice is
specific to a particular collection of Personal Information, it will provide more
specific information about BizSearch’s information-handling practices than this
Privacy Policy.

(c) By providing your Personal Information to BizSearch, you acknowledge that
you are authorised to provide such information to BizSearch.
3.2 Collection from third parties

(a) BizSearch may collect Personal Information about you from third parties,
such as
from:

(i) users of the BizSearch Platform who publish or post Reviews about
you
on, or via, the BizSearch Platform;
-
(ii) publicly available sources; and
-
(iii) other third parties (including BizSearch’s related bodies
corporate,
business partners and service providers, credit reporting bodies, credit
providers, government agencies and cloud-based accounting software
providers).

(b) If a third party provides BizSearch with Personal Information about you,
BizSearch
rely on them to:

(i) inform you that they are providing their Personal Information to
BizSearch;
and
-
(ii) advise you that you can contact BizSearchs for further
information about
BizSearch privacy practices.

(c) Any third party collecting and sharing your Personal information with
BizSearch,
must take reasonable steps to ensure that you are aware of, and consent to, the
matters outlined in this Privacy Policy, including that your Personal Information is
being collected, the purposes for which that information is being collected, the
intended recipients of that information, the individual's right to access that
information, who BizSearch are, and how to contact BizSearch.
4. How BizSearch use your Personal Information
BizSearch use and disclose your Personal Information for the purposes for which the
information is collected, including (but not limited to):

(a) providing you with access to, or use of, the BizSearch Platform and
Services
(including, but not limited to, to providing you with the means through which to
access, post, publish, submit or shares Reviews on, or via, the BizSearch
Platform or any third party products or services made available to you through
the BizSearch Platform);

(b) informing you about the BizSearch Platform, the Services, third party
products
or services or about offers, competitions, promotions, events, sweepstakes,
surveys, questionnaires about BizSearch, the BizSearch Platform, Services or
other matters which BizSearch believe are of interest to you (such as
recruitment or job opportunities);

(c) manage, administer, improve, test, develop and upgrade the BizSearch
Platform, the Services and any other ancillary products and services BizSearch
may offer from time to time, informing you about scheduled maintenance or
outages and managing BizSearch’s relationship with you or to otherwise
investigate complaints about the BizSearch Platform and Reviews;

(d) share with BizSearch’s Third Party Providers;

(e) charge and bill you to access and use the BizSearch Platform;
-
(f) verifying your identity;

(g) for internal record keeping;
-
(h) for direct marketing purposes (see below);
-
(i) complying with BizSearch’s legal and regulatory obligations;

(j) for any purpose to which you have consented; and
-
(k) for any other purpose notified to you at the time of collection.
5. Disclosure to Third Parties
5.1 Third Party Providers

(a) In order to provide or deliver the BizSearch Platform and Services to
you,
BizSearch may disclose your Personal Information to:

(i) BizSearch’s affiliates, related bodies corporate, business
partners, service
providers, third party contractors, agents or suppliers, external business
advisors or other authorised external service providers who perform
functions on BizSearch’s behalf (such as credit reporting bodies, credit
providers, third party payment processors, hosting companies, web
developers, internet service providers, telecommunication providers,
customer service providers, customer support specialists, fulfilment
companies, external business advisors (such as auditors and lawyers),
government agencies, public registries, search agencies, regulatory and
licensing bodies, parties to whom you refer BizSearch to (for example,
previous employers and referees), recruitment agencies and from publicly
available sources of information (for example, online databases and social
media) (collectively, Third Party Providers); and
-
(ii) law enforcement bodies or regulatory authorities to assist with
their
functions, or as otherwise required or authorised by law.

(b) Prior to the disclosure of Personal Information to Third Party Providers,
BizSearch
will take such steps as reasonable in the circumstances to ensure that the Third
Party Providers treat your Personal Information securely and otherwise complies
with the relevant Australian Privacy Principles in relation to the Personal
Information.
5.2 Third party payment processor
BizSearch use a third party payment processor to process payments made to BizSearch.
In connection with the processing of such payments, BizSearch do not collect, process,
use, share, store or disclose any payment information (such as credit card and bank
account details). Rather, all such information is provided directly to BizSearch’s third
party processor, Stripe, whose use of your Personal Information (including payment
information) is governed by their privacy policy, which may be viewed at
www.stripe.com/au/privacy.
6. Marketing communications
6.1 BizSearch may use and disclose your Personal Information to send you
information
about the BizSearch Platform and Services, as well as other content, resources,
products and services offered by BizSearch (or Third Party Providers) and other
information that may be of interest to you. BizSearch may send this information to you
in
a variety of ways, such as by email, SMS, telephone, social media or by customising
online content and displaying advertising through the newsfeed on the BizSearch
Platform.
6.2 If you do not wish to receive any of these marketing communications, you can
opt out by
following the unsubscribe instructions included in the relevant marketing communication,
or by contacting BizSearch using the contact details set out in section 13 below.
7. Overseas disclosures of Personal Information
7.1 In the course of providing you with the BizSearch Platform and Services, it
may become
necessary or desirable to disclose Personal Information to Third Party Providers located
overseas. The countries in which these overseas recipients may be located will depend
upon the individual circumstances. Those countries that BizSearch may disclose your
Personal Information to that are located outside of Australia include the United States,
Indian, the Philippines and elsewhere in the world.
7.2 The laws where these overseas recipients may be located provide various
levels of
protection for Personal Information which are not always equivalent to the level of
protection that may be provided for in Australia. Where BizSearch transfer your Personal
Information overseas BizSearch will take reasonable steps to ensure that your Personal
Information is treated securely and the means of transfer provides adequate safeguards.
8. Notifiable Data Breaches Scheme
In the event of any loss, or unauthorised access or disclosure of your Personal
Information
that is likely to result in serious harm to you, BizSearch will investigate and notify
you and
the Australian Information Commissioner as soon as practicable, in accordance with
notifiable data breach scheme contained in Part IIIC of the Privacy Act.
9. Security of your Personal Information
9.1 BizSearch take steps reasonable in the circumstances to ensure that the
Personal
Information it holds is protected from misuse, interference and loss and from
unauthorised access, modification or disclosure.
9.2 The transmission of information via the Internet is not completely secure.
BizSearch
cannot guarantee the security of your data transmitted to or via the BizSearch Platform
and any transmission is at your own risk.
9.3 BizSearch will destroy or de-identify Personal Information in circumstances
where it is
no longer required, unless BizSearch are otherwise required or authorised by law to
retain the information.
10. Accessing and correcting your Personal Information
10.1 BizSearch take steps reasonable in the circumstances to ensure Personal
Information
BizSearch hold is accurate, up-to-date, complete, relevant and not misleading. Under
the Privacy Act, you have a right to access and seek correction of your Personal
Information that is collected and held by BizSearch.
10.2 If at any time you would like to access or correct the Personal Information
BizSearch
hold about you, or you would like more information about BizSearch’s approach to
privacy, please contact BizSearch via the contact details set out in section 13
below. If
BizSearch refuse your request to access or correct your Personal Information,
BizSearch will provide you with written reasons for the refusal and details of complaint
mechanisms.
11. Cookies and Google Analytics
11.1 BizSearch use small text files placed on your computer called ‘cookies’ to
collect
standard log and visitor behaviour information in an anonymous form. BizSearch
use this information to analyse how visitors use the BizSearch Platform and
BizSearch website and to compile statistical reports on BizSearch Platform activity.
You can set your computer or device to reject cookies, but this may affect your
ability to use certain parts of the BizSearch Platform or website.
11.2 Services that the BizSearch Platform may use from time to time include
Google
Analytics, which transmits website traffic data to Google servers. Google Analytics
does not identify individual users or associate your IP address with any other data
held by Google. BizSearch use reports provided by Google Analytics to help
understand traffic and usage on the BizSearch Platform. By using the BizSearch
Platform, you consent to Google processing your data in the manner described in
Google’s Privacy Policy (www.policies.google.com/privacy) and for the purposes set
out in this Privacy Policy.
11.3 Google may pass on cookies to its partners and other third parties to
achieve its

12. Children's policy

(a) BizSearch do not knowingly seek, collect or process Personal Information
from or
about persons under the age of 18 years of age ( Children )
without the consent of
a parent or guardian.

(b) If BizSearch become aware that any Personal Information relating to a
Child has
been provided without the consent of a parent or guardian, BizSearch will use
reasonable endeavours to:

(i) delete the Personal Information from all relevant files as soon
as possible;
or
-
(ii) ensure, where deletion is not possible, that the Personal
Information is not
used further for any purpose or disclosed further to any Third Party
Provider.

(c) Any parent or guardian with queries regarding BizSearch’s collection,
use,
processing or disclosure of Personal Information relating to their Child should
contact BizSearch using the details below.

14. Changes to this Privacy Policy
From time to time, it may be necessary for BizSearch to review and revise its Privacy

BizSearch Platform from time to time to ensure you are familiar with BizSearch’s latest
Privacy Policy.
